Terms and Conditions

Old-design is a sole proprietorship (EI) registered with the Lyon Trade and Companies Register under SIREN number 914 316 070, with its registered office located at 22 chemin des Carrières, 69250 Albigny-sur-Saône, France. It is subject to VAT and corporate income tax (IS).

Old-design is a company specializing in the online sale of vintage furniture (both restored and unrestored secondhand pieces), lighting fixtures, decorative items, and works of art.

ARTICLE 1 – SCOPE OF APPLICATION

1-1 These Terms and Conditions of Sale (hereinafter the “T&C”) apply, without restriction or reservation, to all products offered for sale on the website https://old-design.com/, phone 0662567977, email : oldsg1@gmail.com.

1-2 Consequently, by placing an order on the website, any individual or legal entity (hereinafter the “Customer”) fully and unconditionally accepts these Terms and Conditions.

1-3 These Terms and Conditions will remain in effect until a new version is posted online. Therefore, before confirming an order, the Customer must review and accept these Terms and Conditions.

1-4 Old-design reserves the right to amend or modify these Terms and Conditions at any time. In the event of any changes, the Terms and Conditions in effect at the time the order is placed will apply to each order.

ARTICLE 2 – PRODUCTS AND AVAILABILITY

2.1 Old-design offers for sale on its website vintage furniture—that is, used furniture, whether restored or unrestored—as well as lighting fixtures, decorative items, and works of art. The “Customer” is informed that all products offered on the website are secondhand and may therefore, by their nature, have defects and signs of wear. Old-design is free to select the products offered for sale on the website and reserves the right to modify this selection at any time.

2-2 Product Description: Old-design provides a description of the product in question, including its key features, dimensions, and price. All products are illustrated with photographs that provide the most reliable and accurate representation of the actual item. Old-design cannot guarantee that the shades and colors of the products will match exactly those shown in the photographs on the website. This is expressly acknowledged and accepted by the “Customer.”

2-3 The “Customer” must verify the dimensions listed in each product’s description before placing an order. Old-design shall not be held liable and shall not be required to exchange or refund the product if it cannot be installed at the “Customer’s” location (including access to the installation site) due to its dimensions.

2-4 Old-design strives to provide the “Customer” with the most reliable product information possible; however, it does not guarantee the accuracy or completeness of such information. The customer may contact Old-design via the website or by email, as indicated at the top of the contract, for any additional inquiries.

2-5 If an “Old-design” product is out of stock, the “Customer” will be notified by email, and the order for that specific product will be automatically canceled. The remainder of the order remains firm and final. If payment for that product has already been charged to the customer’s account, a refund will be issued. Otherwise, the price of the unavailable product will not be charged.

ARTICLE 3 – THE ORDER

3.1 Registration: To place an order, the “Customer” must complete a form available on the website and provide the necessary information requested. Before placing each order, the “Customer” must verify their information and update it if necessary. Old-design emphasizes that it is essential for the customer to provide a valid email address, phone number, and mailing address.

3-2 Upon creating a customer account, the “Customer” must provide a confidential password. The Customer is solely responsible for this password and their login credentials. Old-design guarantees the confidentiality of this information. The “Customer” may unsubscribe from the site at any time by simply sending a request to the site’s email address.

3-3 A “Customer” wishing to purchase a product clicks the “Add to Cart” button on the selected product page. The Buyer may add multiple products to their cart.

3-4 The “Customer” may also submit a purchase request using the contact form.

3-4 Old-design will acknowledge receipt of the order to the “Customer” by sending an order confirmation email that summarizes the order details, the product price, and the shipping cost.

3-5 Old-design reserves the right to cancel any order placed by a “Customer” with whom there is a pre-existing dispute.

3-6 The information provided by the “Customer” when placing an order is binding on the Customer: in the event of any error in this information—including, but not limited to, the recipient’s email address and contact details—whether false, incomplete, or misspelled, Old-design shall not be held liable for any failure to deliver the product.

Any delivery made to the address provided by the “Customer” will be considered successful.

In the event of a reshipment due to a lack of information and/or an error on the part of the “Customer,” the costs incurred by such reshipment may be billed to the “Customer.”

ARTICLE 4 – PRICE

Le prix d’un produit correspond au prix emporté, c’est-à-dire hors frais de livraison (sauf pour la région Rhône, lorsque la livraison est incluse).

Old-design is subject to value-added tax (VAT).

In accordance with the provisions of Article 297 A of the General Tax Code, most used goods offered for sale are subject to the special VAT margin scheme. Under this scheme, VAT is included in the selling price but is not listed separately on invoices.

However, certain items may qualify as antique furniture or collectibles under the current tax legislation enacted by the law of January 2025. These items are then subject to VAT at the reduced rate of 5.5%, applicable in accordance with current legal provisions.

The VAT rate applicable to each product is determined based on its nature and tax classification.

4-2 If a product has an incorrect price listed on the website, for example, a discrepancy between the actual price and the price listed on the website, Old-design may, after the order has been confirmed, notify the customer of the corrected actual price, cancel the order, and issue a refund.

4-3 The listed price of the product is the final price.

ARTICLE 5 – PAYMENT TERMS

5-1 Orders are payable exclusively in euros.

5-2 Payment for orders is made:

Old-design will contact the “Customer,” who will then have the opportunity to settle:

ARTICLE 6 – SHIPPING COSTS

6-1 Les frais de transport seront rajoutés pour la France Métropolitaine et en Corse à la commande. Ils sont calculés à partir des dimensions du produit et de son poids. Le devis sera envoyé à la commande ou bien sur demande par mail. La livraison à Lyon et la région Rhône est gratuite.

6-2 Shipping costs for deliveries within Europe or worldwide are calculated based on the product’s dimensions, weight, value, and destination country. Customers must request a quote via email. A response will be provided within one week at the latest.

6-4 Customs Duties: Orders placed outside mainland France may be subject to additional charges, such as import duties, local taxes, and customs duties. These charges are applied upon receipt of the product in the relevant country.

ARTICLE 7 – SHIPPING AND DELIVERY

7-1 The mode of transport varies in accordance with the provisions of Article 6.

7-2 Delivery includes delivery to the building entrance or to the customer’s doorstep.

7-3 If the “Customer” wishes to have the item delivered directly to their home, including installation, they must request a quote from Old-design via email. The cost will be determined based on the item’s dimensions, weight, and accessibility (floor level, narrow passageways, etc.).

7-4 Delivery Times: Products are delivered within a reasonable timeframe after payment is received. This timeframe is less than two weeks in Lyon and the Rhône region, as Old-Design handles delivery itself in this area. Old-Design uses specialized shipping companies for deliveries throughout France, Europe, and the rest of the world. In such cases, the delivery times of these companies must be added. It may also use the collaborative shipping platform Cocolis, which includes insurance.

Delivery within France takes one to four weeks, depending on the destination; delivery times are shorter along the Paris-Lyon-Marseille route. Delivery within Europe takes four to six weeks. Minimum delivery times cannot be specified for international destinations.

Old-Design shall not be held liable for any consequences resulting from a potential delay in the delivery of the ordered products.

7-5 Products are delivered to the shipping address provided by the “Customer” when placing the Order. If there is an error in the “Customer’s” contact information (last name, first name, street name and number, ZIP code, phone number, or email address), Old-Design cannot be held responsible for any failure or delay in delivery.

7-6 The “Customer” must check the contents and condition of the product before accepting delivery. The “Customer” shall refuse delivery if it does not match the order. The customer must note this on the carrier’s delivery slip and notify Old-Design of the refusal by email. Otherwise, the product is considered to be in compliance with and consistent with the order. Old-Design will therefore not accept any complaints.

ARTICLE 8 – CANCELLATION PERIOD AND RETURNS

8-1 In accordance with Article L.221-18 of the Consumer Code, the “Customer” has a minimum of fourteen days from the date of receipt of the order to exercise their right of withdrawal. They must submit a written request (by letter or email).

8-2 Old-design reminds the “Customer” that they must take special care of the Products. All returned Products will be inspected, and in all cases must be returned complete (i.e., with all accessories and other parts received with the Products in their original condition).

8-3 The customer is responsible for arranging the return and covering the associated costs. Under no circumstances will Old-Design be required to arrange for the return of canceled products. The product must be returned in packaging of a quality equivalent to that in which it was received (bubble wrap, protective plastic film, cardboard, etc.).

8-4 The return must be made within 14 days of Old-Design’s receipt of the cancellation notice.

8-5 The refund will be issued upon receipt of the returned item. Old-design will have 14 days to process the refund for the “Customer.”

ARTICLE 9 – WARRANTIES

9-1 All products are inspected before packaging and shipment to ensure they match their descriptions on the Old-Design website.

9-2 The “Customer,” as defined in Article 7, must notify the carrier of any reservations regarding the product prior to signing the delivery document and must refuse the product if it does not comply with the order (e.g., damaged package, product does not match the order, etc.).

9-3 Disclaimer of Warranties: Any defects affecting the products or their characteristics are not covered by any statutory or contractual warranty. Damage caused by the “Customer” as a result of improper or non-compliant use of the products is also not covered by any warranty.

ARTICLE 10 INTELLECTUAL PROPERTY

10-1 All elements of the website (logo, photos, text, fonts, etc.) are and remain the exclusive intellectual property of Old-Design.

10-2 Any unauthorized reproduction and/or display, in any form whatsoever, of an image or photograph owned by Old-Design and appearing on the website constitutes infringement and will be subject to legal action.

ARTICLE 11 PROTECTION OF PERSONAL DATA.

11-1Old-design is committed to protecting personal data. It is committed to ensuring the highest level of protection for your personal data in accordance with applicable European and French data protection regulations.

11-2 In order to fulfill orders and provide services, Old-Design must process its customers’ personal data. If the required fields are not filled out, Old-Design will be unable to process orders.

11-3 The “Customer’s” data will be used exclusively by Old-design and will not be disclosed to any third parties.

Article 12 SETTLEMENT OF DISPUTES

12-1 Any complaints may be submitted by email to oldsg1@gmail.com or by phone at 0662567977, and the “Customer” will receive a response as soon as possible.

12-2En cas de difficultés, le client a la possibilité, avant toute médiation et toute action en justice, de rechercher une solution amiable notamment avec l’aide d’une association professionnelle de la branche, d’une association de consommateurs.

12-3 Any dispute that cannot be resolved amicably shall be referred to the courts of general jurisdiction.
