Old-design is a company specializing in the online sale of vintage furniture (both restored and unrestored secondhand pieces), lighting fixtures, decorative items, and works of art. <\/span><\/p>\n ARTICLE 1 \u2013 SCOPE OF APPLICATION<\/b><\/p>\n 1-1 These Terms and Conditions of Sale (hereinafter the \u201cT&C\u201d) apply, without restriction or reservation, to all products offered for sale on the website <\/span>https:\/\/old-design.com\/<\/span><\/a>, phone 0662567977, email : <\/span>oldsg1@gmail.com<\/span><\/a>.<\/span><\/p>\n 1-2 Consequently, by placing an order on the website, any individual or legal entity (hereinafter the \u201cCustomer\u201d) fully and unconditionally accepts these Terms and Conditions.<\/span><\/p>\n 1-3 These Terms and Conditions will remain in effect until a new version is posted online. In the event of any changes, the Terms and Conditions in effect at the time the order is placed will apply to each order. <\/span><\/p>\n ARTICLE 2 \u2013 PRODUCTS AND AVAILABILITY<\/b><\/p>\n 2.1 Old-design offers for sale on its website vintage furniture\u2014that is, used furniture, whether restored or unrestored\u2014as well as lighting fixtures, decorative items, and works of art. The \u201cCustomer\u201d is informed that all products offered on the website are secondhand and may therefore, by their nature, have defects and signs of wear. Old-design is free to select the products offered for sale on the website and reserves the right to modify this selection at any time. <\/span><\/p>\n 2-2 Product Description: Old-design provides a description of the product in question, including its key features, dimensions, and price. All products are illustrated with photographs that provide the most reliable and accurate representation of the actual item. Old-design cannot guarantee that the shades and colors of the products will match exactly those shown in the photographs on the website. This is expressly acknowledged and accepted by the \u201cCustomer.\u201d <\/span><\/p>\n 2-3 The \u201cCustomer\u201d must verify the dimensions listed in each product\u2019s description before placing an order. Old-design shall not be held liable and shall not be required to exchange or refund the product if it cannot be installed at the \u201cCustomer\u2019s\u201d location (including access to the installation site) due to its dimensions. <\/span><\/p>\n 2-4 Old-design strives to provide the \u201cCustomer\u201d with the most reliable product information possible; however, it does not guarantee the accuracy or completeness of such information. The customer may contact Old-design via the website or by email, as indicated at the top of the contract, for any additional inquiries. <\/span><\/p>\n 2-5 If an \u201cOld-design\u201d product is out of stock, the \u201cCustomer\u201d will be notified by email, and the order for that specific product will be automatically canceled. The remainder of the order remains firm and final. If payment for that product has already been charged to the customer\u2019s account, a refund will be issued. Otherwise, the price of the unavailable product will not be charged. <\/span><\/p>\n ARTICLE 3 \u2013 THE ORDER <\/b><\/p>\n 3.1 Registration: To place an order, the \u201cCustomer\u201d must complete a form available on the website and provide the necessary information requested. Before placing each order, the \u201cCustomer\u201d must verify their information and update it if necessary. Old-design emphasizes that it is essential for the customer to provide a valid email address, phone number, and mailing address. <\/span><\/p>\n 3-2 Upon creating a customer account, the \u201cCustomer\u201d must provide a confidential password. The Customer is solely responsible for this password and their login credentials. Old-design guarantees the confidentiality of this information. The \u201cCustomer\u201d may unsubscribe from the site at any time by simply sending a request to the site\u2019s email address. <\/span><\/p>\n 3-3 A \u201cCustomer\u201d wishing to purchase a product clicks the \u201cAdd to Cart\u201d button on the selected product page. Customers must request a quote via email. A response will be provided within one week at the latest. <\/span><\/p>\n 6-4 Customs Duties: Orders placed outside mainland France may be subject to additional charges, such as import duties, local taxes, and customs duties. These charges are applied upon receipt of the product in the relevant country. <\/span><\/p>\n ARTICLE 7 \u2013 SHIPPING AND DELIVERY<\/b><\/p>\n 7-1<\/span> The mode of transport varies in accordance with the provisions of Article 6.<\/span> <\/p>\n 7-2 Delivery includes delivery to the building entrance or to the customer\u2019s doorstep. <\/span><\/p>\n 7-3 If the \u201cCustomer\u201d wishes to have the item delivered directly to their home, including installation, they must request a quote from Old-design via email. The cost will be determined based on the item\u2019s dimensions, weight, and accessibility (floor level, narrow passageways, etc.). <\/span><\/p>\n 7-4 Delivery Times: Products are delivered within a reasonable timeframe after payment is received. This timeframe is less than two weeks in Lyon and the Rh\u00f4ne region, as Old-Design handles delivery itself in this area. Old-Design uses specialized shipping companies for deliveries throughout France, Europe, and the rest of the world. In such cases, the delivery times of these companies must be added. It may also use the collaborative shipping platform Cocolis, which includes insurance. <\/span><\/p>\n Delivery within France takes one to four weeks, depending on the destination; delivery times are shorter along the Paris-Lyon-Marseille route. Delivery within Europe takes four to six weeks. Minimum delivery times cannot be specified for international destinations. <\/span><\/p>\n Old-Design shall not be held liable for any consequences resulting from a potential delay in the delivery of the ordered products.<\/span><\/p>\n 7-5 Products are delivered to the shipping address provided by the \u201cCustomer\u201d when placing the Order. If there is an error in the \u201cCustomer\u2019s\u201d contact information (last name, first name, street name and number, ZIP code, phone number, or email address), Old-Design cannot be held responsible for any failure or delay in delivery. <\/span><\/p>\n 7-6 The \u201cCustomer\u201d must check the contents and condition of the product before accepting delivery. The \u201cCustomer\u201d shall refuse delivery if it does not match the order. The customer must note this on the carrier\u2019s delivery slip and notify Old-Design of the refusal by email. Otherwise, the product is considered to be in compliance with and consistent with the order. Old-Design will therefore not accept any complaints. <\/span><\/p>\n ARTICLE 8 \u2013 CANCELLATION PERIOD AND RETURNS<\/b><\/p>\n 8-1 In accordance with Article L.221-18 of the Consumer Code, the \u201cCustomer\u201d has a minimum of fourteen days from the date of receipt of the order to exercise their right of withdrawal. They must submit a written request (by letter or email). <\/span><\/p>\n 8-2 Old-design reminds the \u201cCustomer\u201d that they must take special care of the Products. All returned Products will be inspected, and in all cases must be returned complete (i.e., with all accessories and other parts received with the Products in their original condition). <\/span><\/p>\n 8-3 The customer is responsible for arranging the return and covering the associated costs. Under no circumstances will Old-Design be required to arrange for the return of canceled products. The product must be returned in packaging of a quality equivalent to that in which it was received (bubble wrap, protective plastic film, cardboard, etc.). <\/span><\/p>\n 8-4 The return must be made within 14 days of Old-Design\u2019s receipt of the cancellation notice.<\/span><\/p>\n 8-5 The refund will be issued upon receipt of the returned item. Old-design will have 14 days to process the refund for the \u201cCustomer.\u201d <\/span><\/p>\n ARTICLE 9 \u2013 WARRANTIES<\/b><\/p>\n 9-1 All products are inspected before packaging and shipment to ensure they match their descriptions on the Old-Design website.<\/span><\/p>\n 9-2 The \u201cCustomer,\u201d as defined in Article 7, must notify the carrier of any reservations regarding the product prior to signing the delivery document and must refuse the product if it does not comply with the order (e.g., damaged package, product does not match the order, etc.).<\/span><\/p>\n 9-3 Disclaimer of Warranties: Any defects affecting the products or their characteristics are not covered by any statutory or contractual warranty. Damage caused by the \u201cCustomer\u201d as a result of improper or non-compliant use of the products is also not covered by any warranty. <\/span><\/p>\n ARTICLE 10 INTELLECTUAL PROPERTY<\/b><\/p>\n 10-1 All elements of the website (logo, photos, text, fonts, etc.) are and remain the exclusive intellectual property of Old-Design.<\/span><\/p>\n 10-2 Any unauthorized reproduction and\/or display, in any form whatsoever, of an image or photograph owned by Old-Design and appearing on the website constitutes infringement and will be subject to legal action.<\/span><\/p>\n ARTICLE 11 PROTECTION OF PERSONAL DATA.<\/b><\/p>\n 11-1Old-design is committed to protecting personal data.
